What To Do During An Investigation and Before Arrest- Call Your Attorney!
From the very moment you believe you are under criminal investigation, for any reason, retain experienced legal counsel immediately. The best time to start protecting your legal rights is during the early stages of a criminal investigation.
Not only will your lawyer have the best opportunity to protect your constitutional rights, but early involvement in a case will give your lawyer the very best opportunity to help avoid criminal files being brought against you in the first place. In many cases, you lawyer may be able to avoid having any charges filed or the charges reduced before filing.
If you are approached in person or over the telephone by investigating police officers for questioning, it is in your best interest to remain silent and immediately ask for your lawyer to be present. The fact of the matter is that any questions the officers would like you to answer can just as easily be answered with your attorney present.
Why do we caution you on this issue? Because most investigators are skillfully trained and have years of experience interviewing suspects and witnesses. Trying to hold your own with these experts is similar to putting a baby bunny rabbit in to a cage with a hungry full grown mountain lion. The results will not be pretty!
What To Do After Arrest- Call Your Attorney!
If you are arrested without notice, assert your right to remain silent (assert your "Miranda" rights and politely ask for your lawyer. Do not speak to the investigating authorities until you have first consulted with your attorney. Again, DO NOT answer any questions, assert your "Miranda" rights and ask for your attorney.
You may want to print out and carry the following "Miranda" request with you at all times:
"My lawyer has instructed me not to talk to anyone about my case or anything else, and not to answer questions or reply to accusations. On advice of counsel and on the grounds of my rights under the fifth and sixth amendments, I shall talk to no one in the absence of counsel. I shall not give any consents or make any waivers of my legal rights. Any requests for information or for consent to conduct searches or seizures or investigations affecting my person, papers, property, or effects should be addressed to my lawyer: PRINT YOUR LAWYER'S CONTACT INFO HERE. I request that my lawyer be notified and allowed to be present if any identification confrontations, tests, examinations, or investigations of any sort are conducted in my case, and I do not consent to any such confrontations, tests, examinations, or investigations."
